Terms of services

I. Restriction

We commit to provide the best services to the customers. To do that, we would like to give you some instruction to follow. Customers need to accept these terms when ordering services by telephone. These terms are always applied when customers discuss via email, chatting or contact directly with any staff. Those agreements happen during the registering process, included terms of service about using this website when the customers register the domain name on the Internet. If you do not agree to these terms, please do not use 3inetworks’s services. This site is owned and operated by 3inetworks JSC (referred to as "3inetworks", "3inetworks JSC", "we", "us" or "our"). No material from the site may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way.

Those services provided by 3inetworks must be applied according to the law. Transferring, backing up or displaying under any data or information forms that against the law of Socialist Republic of Vietnam and United State law are banned. This also includes those documents which are not allowed using by 3inetworks such as the registered business secret documents, pornography or any documents that breach the author right, copyright, brand and intellectual property right etc. 3inetworks will be guaranteed by customers to avoid complaints due to the service using that harms directly, in directly, randomly or intentionally to themselves or any related party, or inaccessible this website, or the belief in information on the website or even the information advised by an other agency.

II. Services

  1. Customer’s web hosting account at datacenters can be connected 99.9% uptime or longer on the Internet. Customers will receive our technical support for anything related to our services. The technical support will be carried out immediately during the day in 30 minutes after getting request from customers. However, we deny to provide technical support if customers have not paid the service fee.
  2. Technical support is carried out via helpdesk. Because of information saving requested by customers, we do not provide telephone support. Each request has an unique ID number and replied emails will be sent customers automatically. If you do not receive any information, please log in the helpdesk and resend your requests.
  3. After registering, each customer has an individual ID. We can not provide technical support without that ID.
  4. We support the backing up for web hosting accounts, servers and VPS managed by us (except the server and VPS managed by customers) daily and weekly. Each 24 hours, the yesterday’s backing up data will be destroyed and a new backup will be set up. After one week, the last week’s backing up will be replaced by a newer backing up. However, we encourage the customers to back up their individual data by themselves.
  5. The shared hosting server will limit 2000 emails sent out per day. If you send over that number, the system will cut off its out line. Then customers want to use more than that, please contact sales@3inetwork.com to get better solution.
  6. In order to protect our work and no one can change the customer’s code, all the websites developped by 3inetworks will be encoded before giving to the customers. If customers want to access all the code, please contact sales@3inetwork.com for full information.

III. Payments and fees

  1. Customers need to complete all the payments at the right day announced via email after ordering or ten days before renewing
  2. The payment confirmation must be done latest in one day from the expired day. If the confirmation cannot be on time, the customer’s account will be stopped. After seven days, if customers do not pay, the account will be deleted without announcement.
  3. Setup fees are $10 (one-time fee) for shared hosting accounts, $50 (one-time fee) for VPS, and are $250 (one-time fee) for dedicated servers unless otherwise stated. Please note that dedicated servers setup fees and renting fees are Non-Refundable.
  4. 3inetworks JSC is authorized to charge the client credit card according to the current account pricing. 3inetworks JSC has a right to charge late fees at a rate of 20% of the invoiced amount. There is a $1 declined charge administrative fee for all charges declined due to the client’s error. We reserve the right to reassess this charge for any account that continuously has a credit card that is declined.
  5. For personal hosting, when requested to restore data from our own backups, we will make all attempts to restore customer's data for a fee of $10 per each restore request.
  6. For other hosting plans, once account is suspended, it can be re-activated again with a reactivation fee of one month charge for the plan you were using before suspending (in case we still keep your backup). If your account is terminated by violating this Terms of Services, we refuse to provide your data backup.
  7. If you wish to cancel your service for whatever reason, please submit a ticket to our billing department with your payment method and customer ID. Please note that we do require 10 days notice before your billing date to process your cancellation. In the event of late cancellation, you will still be charged.
  8. In case of system disconnection occurs, excepting unexpected following cases:
    • Natural disasters, war
    • Internet connection problem
    • Time of DNS updating
    • Due to hardware, software system that customers are using
    • System maintaining announced in advance
    • Any cases that do not follow terms of services of 3inetworks JSC
    3inetworks JSC will reduce the cost with 5% value of a contract per two hours if the server does not run normally. In any cases, the service is not connected over ten hours. If that happens, 3inetworks JSC will be punished by 10% of total contract value per day and maximum of the hosting cost in a day. Customers need to contact 3inetworks to solve this.

IV. Refund

  1. Refunds can only be given in the first 30 days and can be applied to hosting service only. This 30 day money back guarantee covers you in the event that we fail to provide the services which you have purchased. In the event that we fail to provide you with the services you have purchased, please submit a ticket to our billing and request your refund.
  2. In the event that you exercise your right to a 30 day money back guarantee, the above set-up fee will be retroactively charged if it was waived in the original charge.
  3. We will also not issue refunds beyond the first 30 days unless exceptional circumstances exist.

V. Client behavior

You agree not to do any of the following

  1. DO NOT SPAM: send unsolicited commercial or bulk email, newsgroup spamming to any party for any reason that may or may not result in a complaint.
  2. DON'T CRACK/DEFACE: access or attempt to access a computer or network resource that you are not authorized to access. You do not have the right to save or distribute any crack tool either.
  3. NO WAREZ, NO RIAA/MPAA IP VIOLATIONS: distribute, or make available in any way to any party intellectual property that requires some method of authorization to sell or distribute, which you do not have.
  4. NO CHILD PORNOGRAPHY: store, transmit, create, or examine any pictures, realistic or not, of humans, anthropomorphic depictions of human-like creatures, or images suggesting humans that are under the age of 18 years in an either implied or actual pornographic picture.
  5. NO SPOOFING: forge email headers or TCP/IP packet headers.
  6. NO DoS, NO WORMS/VIRUSES/TROJANS: distribute worms, trojans or viruses, or commit or attempt to commit any denial of service attack against any computer, network, or individual. If you are DoS’ed we reserve the right to suspend your account to limit the attack. If you are found to have caused the DDOS your account may be suspended or cancelled and you will be billed.
  7. CPU USAGE: On the shared hosting, you cannot run any modern graphical game server (like half-life, quake, etc.) You can run a text mud, but no hogs like the above, please. Also no CPU heavy process likes Seti or Folding@Home. Customers have to consider very carefully when using the CPU power for their accounts. Otherwise, we may suspend customer accounts in cases of registered impact on other accounts on the server or disturbance caused to the functioning of the server. If we do suspend an account, then the owner will be notified and will be advised or the reason for the. The account's owner may be required to upgrade to a larger package using more system resources. We reserve the right to block files or scripts that use CPU to excess and will advice the customer accordingly.
  8. NO HIGH BANDWIDTH P2P PROGRAMS: On the virtual servers no program such as Kazza or Edonkey may be used due to the high bandwidth requirements. These are shared servers and use of such programs affect everyone.
  9. HIGH-RISK SERVICES, which are services that tend to attract denial of service attacks, are strictly prohibited. This includes, but is not limited to, IRC related services and selling of shell accounts.
  10. COPYRIGHT INFRINGEMENT - Software Piracy Policy: our network may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of the Socialist Republic of Vietnam or United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or other intellectual property rights. Making unauthorized copies of software is a violation of the law, no matter how many copies you are making. If caught with pirated software, you or your company may be liable under both civil and criminal law, and you may be filed up to $250,000 and/or receive up to 5 years in jail. In compliance with the Digital Millennium Copyright Act (the "DMCA"), please send DMCA notifications of claimed copyright infringements to our Abuse Division
